Welcome to the AfriDelivery website (the "Website") and AfriDelivery mobile application (the "App"). These terms & conditions ("Terms and Conditions") or ("TnC") apply to the website, app, and all of its divisions, subsidiaries, and affiliate operated Internet sites and mobile applications which reference these Terms and Conditions. This website and app is owned and operated by AfriDelivery Zambia Ltd ("AfriDelivery"). For the purpose of clarification, "seller", "we", "us" and "our" all refer to AfriDelivery.

AfriDelivery reserves the right, to change, modify, add, or remove portions of both the Terms and Conditions of Use and the Terms and Conditions of Sale at any time. Changes will be effective when posted on the App with no other notice provided. Please check these Terms and Conditions regularly for updates. Your continued use of the App following the posting of changes to these Terms and Conditions constitutes your acceptance of those changes.

If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask AfriDelivery to explain it to you before you accept the Terms and Conditions by continuing to use the App.

You confirm that you are at least 18 years of age or are accessing the App under the supervision of a parent or legal guardian.

Both parties agree that this App may only be used in accordance with these Terms and Conditions of Use. If you do not agree with the Terms and Conditions of Use or do not wish to be bound by them, you agree to refrain from using this App.

You agree to give us legit credentials and a working payment method for your order to be processed. The card that you use to make your payment should be legally yours and must have sufficient balance to match the order that you have placed.

You are not allowed to resell the goods that you buy from us unless you have been contracted to do so by AfriDelivery.
1. The Customer shall be entitled to a refund within such period of days as specified depending on the mode of payment used to pay for the services on the Application and on such conditions and/ or circumstances prescribed below.

2. The Customer shall be entitled to benefit under this Refunds Policy only under the conditions as specified below;

a) Where the Customer pre-pays for their Order at the time of making such order on the Application; b) Where it is sufficiently shown that the packaging of the Order made by the Customer has been tampered with; c) Where the Customer’s Order is cancelled by AfriDelivery for the following reasons; i) The Customer’s delivery location is not within the designated AfriDelivery delivery area; ii) Where there is failure of confirmation of the Order by the Customer and/ or AfriDelivery not being able to communicate with the Customer to receive a confirmation of the Order; and iii) Where the Customer cancels the Order due to the items ordered not being available.

3. Subject to Clause 1, the Customer shall be entitled to a full refund of their money which shall be refunded in the manner as prescribed hereunder;

a) Where the Customer pays for their Order with MTN Mobile Money Services or makes a Cash payment for their Order, the refund shall be made within a period of Forty-Eight (48) hours from the time of Order; b) Where the Customer pays for their Order with Airtel Mobile Money Services, the refund shall be made within a period of Seventy-Two (72) hours from the time of Order; and c) Where the Customer pays for their Order with Visa, Debit or Credit Card services or Afriwallet services, the refund shall be made within a period of Fourteen (14) days from the date of Order.

4. AfriDelivery’s decision on refunds shall be to its discretion but without undue regard to the circumstances set out above, and shall be final and binding.All refund amounts shall be credited to Customer’s respective account as prescribed under Clause 3 above.
Any product you order through us will be confirmed by us and the supplier regarding availability either through mail, phone call or in app notification. Placing an order through the App does not establish a binding contract between both parties. AfriDelivery reserves the right to cancel any order without notice at any time.

You agree to provide us with clear delivery instructions for us to be able to facilitate your order. These instructions will be given to the rider and he/she may contact you to confirm the exact delivery location with you.

We provide you with delivery times and preparation times for the order. This should be factored when you are placing the order. AfriDelivery can not, under any circumstances, be held responsible for any delays in processing the order. In case of late delivery the delivery fee still applies, it will not be voided. If AfriDelivery cannot be able to deliver to your location we will inform you using the contact details that you have provided.
Prices listed on the App are subject to change in the future. Possible service charge may be charged depending on the restaurant, this will be added to your total bill. We reserve the right to change the delivery fees in the future. All pricing is quoted in Zambian Kwacha.
You are allowed to cancel your order only immediately (Within one minute) after it has been placed, late cancellation will not be taken into consideration. We can cancel your order in case the product is not available but you will be contacted with alternative suggestions. If your cancellation is accepted then you will be refunded in full. You have the right to reject your order if the wrong item has been delivered. We take any complaints very seriously and we ensure that we follow up on each of them to assure our clients maximum satisfaction.
Both parties agree that all intellectual property rights and database rights, whether registered or unregistered, in the App, information content on the App and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software shall remain at all times vested in us or our licensors. Use of such material will only be permitted as expressly authorized by us or our licensors.

Any unauthorised use of the material and content of this App is strictly prohibited and you agree not to, or facilitate any third party to, copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
Any personal information collected in relation to the use of the AfriDelivery website or app will be held and used in accordance with our Privacy Policy, which is available on our website.

AfriDelivery reserves the right to share personal information, including, but not limited to, contact details, order history, chat and call history and any other information that you shared with AfriDelivery trough our website, app, social media, via phone and in writing. Your data may be shared and used for promotional purposes by AfriDelivery and our partners without getting prior consent.

You have the right to request removal of any data we hold about you. To submit a removal request, please contact us at info@afridelivery.com

We take complaints very seriously and strive to respond to your complaints in the shortest time possible. All complaints should be addressed to info@afridelivery.com
You agree to indemnify and hold us, our affiliates, officers, directors, agents and/or employees, as the case may be, free from any claim or demand, including reasonable legal fees, related to your breach of these Terms of Use and User Agreement.
These Terms and Conditions of Use shall be interpreted and governed by the laws in force in the Republic of Zambia.
In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions of Use or revoke any or all of your rights granted under the Terms and Conditions of Use.

Upon any termination of this Agreement, you shall immediately cease all access to and use of the App and we shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this App in whole or in part.

Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the App shall not be liable to you or to any other person as a result of any such suspension or termination.

If you are dissatisfied with the App or with any terms, conditions, rules, policies, guidelines, or practices of AfriDelivery in operating the App, your sole and exclusive remedy is to discontinue using the App.
If any portion of these terms or conditions is held by any court or tribunal to be invalid or unenforceable, either in whole or in part, then that part shall be severed from these Terms and Conditions of Use and shall not affect the validity or enforceability of any other section listed in this document.
You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Assigning or sub-contracting any of your rights or obligations under these Terms and Conditions of Use to any third party is prohibited unless agreed upon in writing by the seller. We reserve the right to transfer, assign or sub-contract the benefit of the whole or part of any rights or obligations under these Terms and Conditions of Use to any third party. The government of Zambia will govern these terms and conditions.
